These terms and conditions govern Pollieglot’s policy for Friend refunds (“Friend Refund Policy”) and the obligations of the Pollie associated with the Friend Refund Policy. The Friend Refund Policy applies in addition to Pollieglot’s Terms of Service (“Pollieglot Terms”). The Friend Refund Policy is available to Friends who book and pay for a Session through the Pollieglot Platform and suffer a Session Issue (as defined below).
All capitalized terms shall have the meaning set forth in the Pollieglot Terms or Payments Terms unless otherwise defined in this Friend Refund Policy.
By using the Pollieglot Platform as a Pollie or Friend, you are indicating that you have read and that you understand and agree to be bound by this Friend Refund Policy.
A “Session Issue” means any one of the following:
(a) the Pollie of the Session cancels a request shortly before the scheduled start of the session.
(b) the Profile’s description or depiction of the Pollie is inaccurate with respect to:
If you are a Friend and suffer a Session Issue, we agree, at our discretion, to reimburse you up to the amount paid by you through the Pollieglot Platform (“Total Fees”) depending on the nature of the Session Issue suffered. All determinations of Pollieglot with respect to the Friend Refund Policy, including without limitation the size of any refund, shall be in Pollieglot’s discretion, and final and binding on the Friends and Pollies.
To submit a valid claim for a Session Issue and receive the benefits with respect to your request, you are required to meet each of the following conditions:
(a) you must be the Friend that requested the Session;
(b) you must bring the Session Issue to our attention in writing or via telephone and provide us with information (including photographs or other evidence) about the Session and the circumstances of the Session Issue within 24 hours after the later of (i) the start of your request or (ii) you discover the existence of the Session Issue, and must respond to any requests by us for additional information or cooperation on the Session Issue;
(c) you must not have directly or indirectly caused the Session Issue (through your action, omission or negligence); and
(d) unless Pollieglot advises you that the Session Issue cannot be remediated, you must have used reasonable efforts to try to remedy the circumstances of the Session Issue with the Pollie prior to making a claim for a Session Issue.
4.1 If you are a Pollie, you are responsible for ensuring that the Profile you depicted on the Pollieglot Platform meet the Profile description and do not present a Friend with Session Issues.
4.2 If you are a Pollie, and if (i) Pollieglot determines that a Friend has suffered a Session Issue related to a Profile depicted by you and (ii) Pollieglot reimburses that Friend (up to their Total Fees), you agree to reimburse Pollieglot up to the amount paid by Pollieglot within 30 days of Pollieglot’s request. You authorize Pollieglot Payments to collect any amounts owed to Pollieglot by reducing your Payout or as otherwise permitted pursuant to the Payments Terms.
4.3 As a Pollie, if you dispute the Session Issue, you may notify us in writing or via telephone and provide us with information (including photographs or other evidence) disputing the claims regarding the Session Issue, provided you must have used reasonable and good faith efforts to try to remedy the Session Issue with the Friend prior to disputing the Session Issue claim.
5.1 No Assignment/No Insurance. This Friend Refund Policy is not intended to constitute an offer to insure, does not constitute insurance or an insurance contract, does not take the place of insurance obtained or obtainable by the Friend, and the Friend has not paid any premium in respect of the Friend Refund Policy. The benefits provided under this Friend Refund Policy are not assignable or transferable by you.
5.2 Modification or Termination. Pollieglot reserves the right to modify or terminate this Friend Refund Policy, at any time, in its sole discretion. If Pollieglot modifies this Friend Refund Policy, we will post the modification on the Pollieglot Platform or provide you with notice of the modification and Pollieglot will continue to process all claims for Session Issues made prior to the effective date of the modification.
5.3 Entire Agreement. This Friend Refund Policy constitutes the entire and exclusive understanding and agreement between Pollieglot and you regarding the Friend Refund Policy and supersedes and replaces any and all prior oral or written understandings or agreements between Pollieglot and you regarding the Friend Refund Policy.
